After 9-year-old King Overton died after being pulled out of a pool at a SwimRVA learn-to-swim camp this summer, the organization is on both the giving and receiving end of legal cases.
On the receiving end, Overton’s family is suing the Richmond, Virginia organization for $100 million. They accuse the camp and its workers of gross and willing negligence.
On the family’s legal team is prominent civil rights attorney Ben Crump. He represented the victims of many high-profile police brutality cases, including George Floyd and Breonna Taylor, as well as Trayvon Martin, who’s 2012 death at the hands of George Zimmerman helped catalyze the Black Lives Matter movement.
Crump was in Virginia’s capital to file the wrongful death lawsuit last week. The suit alleges that Overton was underwater for 13 minutes until a 7-year-old girl noticed him. The girl then reportedly got an adult – who was not a camp worker – to pull him out of the pool. Overton would then be taken to the hospital, where we would die.
The lawsuit filing claims that there was only one lifeguard on duty when there should’ve been too. It also states that the lifeguard’s view of the pool was obstructed by a large inflatable play device. Most notably, the suit also mentions that the SwimRVA camp should’ve been licensed by the Virginia Department of Education (VDOE) but was not.
The VDOE already found in July, one moth after the incident, that the organization’s camps were not properly licensed, as this lawsuit states. However, SwimRVA is challenging the VDOE over this in court. Local media reports that SwimRVA is accusing the state government of misapplying law and unfoundedly imposing requirements and asking for an exemption from licensure.
”We will get justice for King Overton,” Crump said. “Because King was the best that we had to offer for the future.”
