A Severance police officer who shot a man while responding to a domestic incident will not face criminal charges.
In a Feb. 9 letter to Severance Police Chief Ken Chavez of the investigation, Weld County District Attorney Michael Rourke said he found that the Severance officer was justified in the shooting of 33-year-old Garland Culbertson on Dec. 9, according to a Weld County District Attorney news release.
Severance police responded to a domestic incident call Dec. 9 in the 600 block of Mt. Princeton Drive, where officers found Culbertson sitting in the driver’s seat of a vehicle in the driveway and armed with multiple weapons, according to a Dec. 10 19th Judicial Critical Incident Response Team news release.
An officer fired one shot that struck Culbertson, who was taken to a hospital with injuries that weren’t life threatening, according to the release.
Police arrested Culbertson on charges of theft and second-degree criminal tampering, according to Weld County arrest records. He is set to virtually appear in court March 2 for a status conference.
Additional information about the case, including the identity of the officer and Rourke’s letter to Chavez, is not available because Culbertson is still being prosecuted.
