Greeley elementary school teacher found not guilty of assaulting 6-year-old student

A Greeley elementary school teacher accused of putting a 6-year-old student in a headlock was cleared of all charges in Weld District Court last week.

Josh Wainscott, 41, was acquitted of second-degree assault by strangulation and child abuse by a Weld County jury on April 24, according to Colorado court records.

Wainscott, a library media teacher at Maplewood Elementary, was accused in September of placing the student in a headlock, then picking the child up and carrying him inside.

Wainscott has been employed by Greeley-Evans School District 6 since Aug. 4, 2008, but District 6 communications specialist Theresa Myers said he will officially resign at the end of the school year. He has been on administrative leave throughout the process and has not been in a classroom since his arrest, Myers added.

An email earlier this week to his legal counsel for further details went unanswered.

Wainscott has a hearing to seal the case’s records May 21 in Weld District Court.
