U.S. District Judge Charlotte Sweeney has clarified the scope of the injunction she issued on Friday following a request from the NCAA for clarification on the eligibility ruling.
Sweeney issued an order on Sunday clarifying that her preliminary injunction only grants an additional season of eligibility to members of the high school class of 2022—those who exhausted their eligibility after the 2025-26 campaign—and has no impact on other NCAA rules, such as transfer rules, roster caps or revenue sharing caps.
As a result, athletes granted an additional season remain subject to the NCAA’s existing transfer rules, and the NCAA also made it clear that the ruling does not allow players who have signed a professional contract for the upcoming season to return to college.
Another significant clarification was the fact that the new age-based eligibility rules will apply to those seeking an additional season, meaning that in order for a member of the class to gain a fifth year of eligibility, they must be within five years of when they first enrolled in college or turned 19, whichever occurred earlier.
“The District Court of Colorado has granted the NCAA’s motion to clarify the injunction and make clear that the House Settlement’s roster limits and benefits cap remain fully in effect,” NCAA Chief Legal Officer Scott Bearby said in the NCAA memo.
“According to the Court’s order, class members’ eligibility to participate will be determined by application of the age-based eligibility rule — in other words, they must be within five years of when they first enrolled at any college or turned 19, whichever occurred earlier. All other NCAA eligibility rules, including rules regarding professional participation, remain in effect; as the Court made clear, it was not ruling on any Bylaws not presented to the Court. We now intend to pursue the appellate process and seek a stay of the Court’s order as soon as possible.”
This past Friday, Judge Sweeney granted the preliminary injunction after 11 Division I student-athletes filed a class-action lawsuit over the NCAA’s new five-for-five model in the hopes of securing an additional season of eligibility.
The NCAA Division I Cabinet unanimously approved the new age-based eligibility model last month, which grants student-athletes five years of eligibility starting from the time of their 19th birthday or their full-time college enrollment, whichever comes first.
However, the new rules did not apply to the student-athletes who exhausted their eligibility during the 2025-26 season.
On Monday, Judge Sweeney ruled that the athletes have until Thursday to file a reply brief to the NCAA’s emergency motion, and then the NCAA will have until the following Monday to respond. The NCAA has also said it intends to appeal the preliminary injunction and seek a stay of the order.
