Loyola University asks judge to dismiss womans claims in sexual assault lawsuit

Loyola University is making a legal move in the sexual assault lawsuit filed by 10 former students. Less than a month after NBC 5 Investigates reported about Jane Doe G’s alleged 2019 sexual assault, the university is asking a federal judge to dismiss her claims without a trial.

“I wasn’t a one-off case. I was a victim of a serial assaulter at Loyola, and I wasn’t the first victim. So, that means that my, my situation could have been prevented had the university acted in time,” Jane Doe G told NBC Chicago.

Jane Doe G is one of 10 former students suing Loyola University, all alleging they were sexually assaulted. NBC 5 Investigates just learned Loyola is seeking summary judgment, trying to get Jane Doe G dismissed from the case. Her attorney, Ashley Pileika, said Loyola is trying to treat each woman’s case as an isolated incident.

“This case is not about individual incidents or assaults. It’s about institutional accountability,” said Pileika, an attorney from the Law Office of Darren Wolf.

A spokesperson for Loyola said he cannot comment on active litigation. The new court documents were filed Friday, which was the filing deadline for both parties in the lawsuit. The trial is set for September of next year.

Jane Doe G joined the lawsuit in March 2023. It alleges Loyola systemically mishandled and underreported student complaints of sexual misconduct dating back to 2011.

Loyola attorneys now argue Jane Doe G sued a year too late due to the statute of limitations and that the evidence does not support her claims. In court documents, Loyola says it acted “swiftly” when she disclosed the 2019 incident to her professor, contacting her within 24 hours, suspending the accused student from his residence hall and ultimately expelling him. Court records show the expulsion came more than nine months after her initial report.

“While Loyola has the right to defend itself, we believe that there are significant factual disputes that deserve to be heard by a jury,” Pileika said.

Loyola also argues Jane Doe G was not “deprived of any educational opportunities,” noting that she graduated on time and moved on to a successful career. Her lawyer disputes that.

“The opportunities that she was denied on campus in terms of fully engaging in the life of university student, participating in extracurricular activities, feeling safe in residence halls, in her classes,” Pileika said.

Jane Doe G said the impact has followed her beyond the classroom.

“There are physical ways in which it has changed my life. I have multiple seizures now because of this incident, and they’re all like stress-induced, which is very unfortunate. So my body will probably no longer respond in the way that it’s supposed to, and I’m limited in that way,” she said.
