Investigates: Going inside nursing homes to see whether they’re following transparency laws

ROCHESTER, N.Y. — News10NBC has learned the New York State Department of Health has approved the closure plan for Waterview Heights Rehabilitation and Nursing Center in Rochester.

News10NBC reporter Deanna Dewberry has investigated the nursing home for more than three years. As News10NBC has reported, federal Medicaid leaders are closing the nursing home because the poor care is putting residents in danger.

    The closure plan lays out the process for finding new homes for more than 160 Waterview residents. Waterview leaders aim to place every resident by Sept. 24.

    Family members have contacted Dewberry, frantic to find not just a bed for their loved one but a home. Dewberry set out to see if nursing homes are making available information required by law.

    Experts advise families to always visit a nursing home before placing a loved one. There you can see the most recent inspection report. New York state law mandates that the most recent inspection be available and accessible in a public space in the nursing home.

    With her cell phone in hand, Dewberry walked into Blossom Health Care Center with just one question.

    “Hi I’m Deanna with News10NBC. I was just wondering if I could take a look at your latest inspection?” Dewberry said.

    The clerk didn’t appear to know where it was. But an employee at the desk pointed Dewberry toward a binder at a desk in the lobby. Inside was a page revealing its overall rating of one star, as well as the most recent inspection report in accordance with state law.

    Dewberry’s next stop was Crest Manor, where its sign says it’s 4-star rated by Medicare. The overall rating is actually a one star.

    Inside, when Dewberry asked for the inspection report book, the receptionists didn’t seem to know what she was talking about, but a passing employee. While the report was correctly displayed, Dewberry asked the administrator, who asked not to be on camera, why the sign says four-star when actually it’s a one star.

    He pointed Dewberry to the Care Compare website. At the site, you can type in the name of a nursing home and find out how the Centers for Medicaid and Medicare rates t5he facility. The website clearly shows the Crest Manor has a one-star overall rating but a four-star quality score. The website says the Centers for Medicaid and Medicare uses “a select set of clinical data measures” to calculate the score.

    But CMS places far more weight on inspection reports to calculate the overall rating because the quality measure, based on data, “should not significantly outweigh the rating from actual onsite visits from trained surveyors.”

    The quality score looks at data from the last four quarters. CMS includes data on things like the percentage of residents who have to go to the emergency room, and percentage of residents who have gotten flu shots. But CMS gives more weight to the last two inspection reports. Poor inspections could still result in a low overall score, even with a good quality score.
