Minnesota Gov. Tim Walz recently signed the so-called “Grandparents’ Happy Hour” bill into law, permitting nursing homes and assisted living facilities to serve alcohol to residents during organized activities and events.
A bill-signing ceremony was held last week at Amira Choice Champlin, the Minneapolis-area facility that advocated for the change.
“You have earned the right to make your own choices on this and sometimes, in the best intentions, we get in the way of things. This is one of those cases the government can get out of the way, allow people to make their choices and do this right,” Walz said.
The new law allows nursing homes, boarding care homes and assisted living facilities to serve alcohol without needing a liquor license or permit. Facilities must complete a registration form, allow inspections by law enforcement and only serve alcohol at activities or events for residents and their invited guests, according to the Minnesota Department of Public Safety.
When Amira Choice Champlin was preparing for its grand reopening two years ago, staff discovered they couldn’t legally serve alcohol to residents – unless they obtained a license that effectively made them bartenders.
The measure was approved as one of several amendments to the omnibus liquor policy bill, which was passed by the state legislature and later signed into law.
Under the previous law, assisted living facilities or nursing homes couldn’t serve alcohol at events or host happy hours.
“Just because we’re older and live in assisted living doesn’t mean that we should have fewer freedoms than anyone else,” Amira Choice resident Anita LeBrun, who advocated for the change, told a House committee earlier this year.
Rep. Danny Nadeau, the House sponsor, said the measure provides a “narrow exception” for nursing homes and assisted living facilities.
“I appreciate the purpose of liquor regulations, but sometimes we recognize they go too far,” Nadeau said in a news release.
The law took effect on July 1.
