NEW YORK — New York Attorney General Letitia James and 42 other attorneys general have secured an $18 million settlement with 23andMe over a data breach that exposed millions of customers’ genetic information.

James announced the settlement after a multistate investigation into the October 2023 breach, which 23andMe said impacted nearly 7 million people. The agreement requires 23andMe to adopt new data protection rules and pay more than $700,000 to New York.
In the investigation itself, it found failed safeguards from cyber-attacks, logging, monitoring, or other tools to detect breaches, among other aspects.
“Companies have a duty to protect their customers’ personal information from hackers, but 23andMe put millions of its customers at risk with its flimsy security measures,” said Attorney General James. “New Yorkers trusted 23andMe with their sensitive and personal genetic data, only to find that data stolen and put up for sale on the dark corners of the internet. As a result of our coalition’s action, 23andMe will pay for violating the law and strict rules will be put in place to protect their customers.”
The settlement also imposes security requirements on the 23andMe Research Institute.
