CHARLOTTE, N.Y. — A Charlotte restaurant owner says he’s being unfairly treated by the City of Rochester for code violations he says aren’t all his fault, but his landlord’s – the Port of Rochester, which is owned by the City.
Bob Youst, owner of Whiskey’s Upper Deck at the Port of Rochester, says he’s been there for about a year and a half. But in recent months, he feels targeted by the city for things out of his control. But the city says maintenance is the responsibility of Whiskey’s Upper Deck.
Youst says the city keeps fining him for code violations at his restaurant. He says the city, his landlord, is responsible for half of those code violations.
“So in my lease, it says that maintenance is responsible for me once I take possession. But in there, there’s literature that says that they will make sure everything works proper to turning the possessed space over to me,” Youst said.
Youst says he’s been complaining to the city for months about issues he’s found in their property that he’s currently leasing. Those include faulty fire alarms and doors to his balcony not locking.
It all came to a head around midnight on Saturday, when the city says it shut down Whiskey’s Upper Deck due to 15 fire code infractions.
In a statement, the a City spokesperson told us this:
“Public safety remains the top priority for the City of Rochester. The recent brief closure of Whiskeys Upper Deck at the Port of Rochester – from Friday evening to Saturday mid-day – was a result of 15 fire code infractions. Many of the concerns were very simple fixes, including removing stored items from stairwells, moving an arcade game that was blocking a fire exit, and removing decorations from fire sprinkler lines.”
“The City has worked with the owner of Whiskeys Upper Deck for several months on a variety of issues in an effort to help his business succeed. Unfortunately, the City had to take strong measures last Friday to encourage the owner to make some important changes to adhere to standard fire codes. We are pleased that he has taken the necessary steps to ensure the safety of his patrons.”
“Yes, maintenance is on me, but the issue has not been fixed from day one for it to be turned over to me. These are issues that have not been resolved since the day I moved down, and I’ve been bringing them up every single month to the point they’re sick of hearing me,” Youst said.
Whiskey’s Upper Deck has since reopened for business. It’s open from 4 p.m. to midnight Thursday through Sunday.
