Doug’s Diner restaurants in Fort Collins and Greeley, which temporarily closed late last month amid legal battles between their new and old owners, are set to reopen soon while the court cases continue.
The diner at 801 9th St. in Greeley will reopen Friday, and the location at 2842 Council Tree Ave., Unit 143, in Fort Collins will reopen next week — both managed by their former owners, Rickey Bruening and Ermalinda Hernandez, as the lawsuits play out.
Reached Tuesday afternoon, Bruening confirmed the imminent reopenings, adding that both restaurants are “adding seats and big tables for groups, and bringing back the old menu with lower prices.”
The original owners — Mead-based Doug’s Diner Inc., Milo Inc. and Rickey Bruening Inc. — had sued the eateries’ buyers — Johnstown-based Girl Grub Inc., Fort Fun Foodies Inc., Tricia Drake and Andrea Jensen — in Weld District Court in August, accusing them of not paying royalties and rent required by their contracts.
The new owners responded in late September with lawsuits of their own against the original owners, alleging fraud, breach of contract and defamation. Those counterclaims followed a Sept. 22 ruling by Weld District Judge Kimberly Schutt that could have closed the two diners and forced them to operate under different names.
Restaurant consultant Richard Weil, who said he is working with Bruening, told BizWest in September that attorneys for both sides wanted to move the case to mediation. On Tuesday, Bruening confirmed to BizWest that mediation is ongoing.
Known for breakfast items and made-from-scratch recipes, Doug’s Diner has nine restaurants along the Front Range, including in Boulder, Centennial, Loveland, Mead, Parker, Thornton and Windsor. A new restaurant also is planned in Eaton.
Another Loveland restaurant, Doug’s Day Diner, shares a similar name and history as Doug’s Diner but is not affiliated.
Neither Denver-based attorneys for the new owners, Reed Morris of Denver-based Morris & Watrous PC, nor the old owners, Harold R. Bruno III of Robinson, Waters and O’Dorisio PC, could be reached for comment before BizWest’s afternoon deadline.
