Ellis pointed to separate incidents on Oct. 12 in Albany Park and another on Oct. 14 in the East Side neighborhood as examples where chemical agents like tear gas and pepper spray were used on crowds after her order was entered.
A Department of Homeland Security spokesperson said Bovino was struck in the head by an object prior to the recorded incident. Border Patrol officials have previously testified before Ellis that the use of chemical agents in multiple incidents was justified, alleging protesters were throwing objects at agents.
Attorneys representing protesters, clergy, journalists and other groups have accused Bovino of violating the restraining order, prompting Tuesday’s hearing.
