Drivers to get ‘immediately towed from driveways’ under new ‘clean-up’ law – and warning sign has been axed for good

A NEW “clean-up” law has changed the consequences for drivers who park illegally.

Drivers who violate parking rules will be towed without any warning.

Tennessee drivers will no longer find boots on their car wheels after a new “clean-up” law changes parking penalties, as reported by CBS’s Tennessee news outlet, WTVF.

State representatives are trying to eliminate the practice of putting a boot on drivers’ vehicles.

Instead, lawmakers said drivers who break parking laws should have their cars towed.

“Towing a vehicle out of your driveway is a lot more effective than putting a boot on it,” said Representative Jake McCalmon during a House Government Operations committee hearing.

However, his colleagues are not convinced that towing should be the go-to response.

“If I want to make sure you don’t come back, the boot might do the trick,” said State Representative G.A. Hardaway.

Another lawmaker, Representative John Ray Clemmons, insisted that property managers have seen booting work for vehicles parked at apartment complexes.

Clemmons proposed an exception to the booting ban for these situations.

“We have a lot of tourists coming into our neighborhoods and a lot of tourists in the area,” he said.

“They’ve found that the most effective tool that they have is booting.”

Last year, lawmakers voted to get rid of boots but left it up to Tennessee cities to determine the best course of action.

However, city officials did not jump at the opportunity to regulate the practice, which prompted the new booting bill.

“Booting is very unpopular with our constituency in this state,” said McCalmon.

The bill doesn’t just ban booting; it also requires parking lots to put up warning signs alerting drivers that they use license plate readers.

What to do if your car is towed

Wrongfully or not, retrieving a towed vehicle can be a hassle.

If your vehicle is towed after parking in a “No Parking” zone or other legitimate reason, there are a few steps to take to get it back.

Steps to take when your car is towed:

Try to figure out why your car was towed. Did you not see a posted “No Parking” sign? Did you miss a car payment? Did you return to a lot where you have unpaid citations? Finding the reason can narrow down the phone numbers to dial. Locate the vehicle. Most states, cities, or counties require towing companies to leave some form of contact information via a posted sign or sent by mail. Recovery dates and times depend on the company that towed the vehicle, but those times will be posted to the website or can be recited by a representative. Pay the fees. Be careful to be as prompt as possible, as some tow yards may charge storage fees by the day.

If you feel your vehicle was wrongfully towed, contesting the action can be done with the following steps:

Be prompt – many states have a small window of time where it’s acceptable to file a complaint against a company that wrongfully towed the vehicle. Gather supporting documents: photos, emails, receipts, police reports, and witness statements if applicable. The more evidence, the better. Get familiar with your local laws, as laws for towing companies vary per state. Try speaking with the towing company. Sometimes it may have been a simple oversight, and the matter can be resolved quickly. Contact the Justice of the Peace in your area, as they may have more insight or resources to help. They are often utilized for towing cases. Talk to a lawyer. Many lawyers have free case consultations, and depending on the case, it may be worth it to utilize a lawyer.

Many states are installing these high-speed camera systems that automatically capture and read license plate numbers.

Police departments said the license plate readers provide important information like the location, date, and time of a parking violation.

Drivers whose vehicles were towed can access an online portal that helps them locate the lot that their car had been taken to.

The bill also includes “clean-up” efforts to remove unclaimed vehicles from businesses by allowing officials to hire towing companies.

The bill is expected to pass in the Senate before reaching the House floor, according to WTVF.

Tennessee isn’t the only state to adopt such a law or technology.
