Appealing to Weld District Court with an emergency preliminary junction, Greeley Deserves Better members are eagerly awaiting a decision that could decide the fate of their ballot initiative.
Greeley Deserves Better is a citizens’ initiative that seeks to repeal an ordinance passed by the city council that approved a financing mechanism to fund predevelopment and design work for the Catalyst entertainment district in west Greeley.
Despite collecting more than 5,000 signatures from Greeley voters, a protest was filed and upheld by hearing officer Karen Goldman, who determined the ordinance was administrative in nature and unable to be placed on the ballot. Suzanne Taheri, the attorney representing Greeley Deserves Better, then brought the issue to Weld District Court.
“We are confident that the District Court will recognize this petition as the legislative action it clearly is,” Taheri said in a news release. “The ordinance itself is legislative and, thus, its repeal must be legislative – literally every element of this initiative is legislative in nature.”
District Judge Allison Esser presided over the case on Thursday, informing the attorneys present that her decision would be given late Thursday evening.
Due to the Friday deadline for ballot additions, there is very little chance for the measure to be placed on November’s ballot. However, if Esser sides with Greeley Deserves Better, it is possible that the city could hold a special election in 2026 or place the issue on the 2026 November ballot.
