DENVER — In what some observers are describing as a win for big technology companies, Colorado lawmakers decided — after negotiations on a compromise collapsed during this week’s special legislative session — to push back when the state’s first-of-its kind artificial-intelligence regulations will go into effect, opening up the possibility for tweaks to the law during next year’s regular session.
Passed in 2024, Colorado’s AI law — initially set for implementation next February, but now pushed to June 2026 — aims to reduce discrimination by forcing companies to disclose when AI is used to make business decisions related to housing, medical care, education and finance.
The regulations, crafted by Senate Majority Leader Robert Rodriguez, D-Denver, won the support of progressive lawmakers, consumer advocates, labor organizations and civil- and privacy-rights groups.
“When these systems are making critical decisions about whether you get a job, whether you get an apartment, whether you have access to medical care — you have a right to know what sort of factors those decisions are relying upon,” David Seligman, executive director of labor-rights law firm Towards Justice and a Colorado gubernatorial candidate from the Democratic Party’s progressive wing, said in a statement last week.
The AI regulations faced criticism from tech companies, business groups, pro-business politicians (including some Democrats such as Gov. Jared Polis) and conservative legislators.
Now that implementation of the law has been delayed, critics will likely use the 2026 legislative session to attempt to defang the rules, which they argue could result in tech companies looking outside of Colorado when it comes time to invest, expand or relocate.
“By extending the timeline, we now have the opportunity to work collaboratively on practical solutions that strengthen consumer trust, safeguard jobs and preserve Colorado’s competitiveness,” Colorado Technology Association CEO Brittany Morris Saunders said in a statement Tuesday.
Axios reported Wednesday that “(m)ore than 100 companies and organizations hired roughly 150 lobbyists” to make Colorado’s AI regulations more palatable to big business. “… Those that hired multiple lobbyists included Amazon, major health-care companies and TechNet, a coalition of tech CEOs.”
