Fact Check: New York poll worker ballot rumor is false; stray marks do not disqualify your vote

ROCHESTER, N.Y. — With Election Day less than two weeks away and early voting starting Saturday, a rumor has been spreading online that ballots will be disqualified if a poll worker marks on them.

The warning has appeared on Facebook and in text messages, claiming, “When you are checking in at the polls and they happen to write anything on your ballot before they give it to you to put in the voting machine… your ballot will be disqualified.” The message also says this includes a check mark, a letter, a star, an R or a D, or any writing of any kind.

Different counties in New York use different voting machines, but elections commissioners in four counties told News10NBC the same thing.

“They should never — there’s never an instance when a poll worker would write anything on a ballot,” Gary Nageldinger said.

Nageldinger and David DiPasquale are elections commissioners in Livingston County. They said if a stray mark ends up on a ballot, it would not prevent the vote from being counted. DiPasquale said, “It’ll go through and it will scan it as long as it’s not interfering with the actual categories and/or timing marks of that ballot. It’ll go through.”

If a mark makes selections unreadable, voters would be given a new ballot to fill out. Nageldinger and DiPasquale said they have seen this rumor spread during past election seasons.

“I think it’s just misinformation and to throw doubt into the election process, that’s my opinion,” DiPasquale said.

“Certain groups want to sow discontent in the election, whether it’s to dissuade a set of voters, a certain party, what have you, it’s really just to cause chaos,” Nageldinger said.

While poll workers are trained not to write on ballots, a stray mark will not deny a vote. This rumor is false.

Some states, like North Carolina, require election workers to write on voter ballots for absentee and early-voting ballots, adding identifying numbers or precinct information so ballots can be sorted and retrieved if necessary. Officials said those markings do not invalidate the ballot.
