OCEANO, Calif. (KEYT) - Friends of Oceano Dunes has filed a formal motion to intervene in an ongoing lawsuit brought by the Center for Biological Diversity against California State Parks in the Superior Court of California.
The legal filing seeks to preserve off-highway vehicle access, beach driving and camping at the Oceano Dunes State Vehicular Recreation Area.
The underlying lawsuit challenges California State Parks' habitat conservation plan for the property, alleging that it violates state laws requiring environmental review and protection for rare birds, as well as the California Coastal Act.
The Center for Biological Diversity is seeking judicial relief that could vacate environmental reports and potentially reduce or eliminate motorized recreation and camping at the park.
Friends of Oceano Dunes is a 501(c)(three) California non-profit volunteer organization established in 2001 to preserve camping and off-highway vehicle recreation at the site.
The group represents its members and motorized vehicle users, contending that state officials have not always fully defended the recreation area for its legislated purpose.
Organization leadership says the group remains committed to pursuing legal remedies to protect beach driving, camping and off-highway vehicle recreation as it has occurred for more than 100 years.
Economic factors are also highlighted in the legal dispute.
According to a recent study cited in the press release, visitors coming to Oceano Dunes from outside San Luis Obispo County generate more than $500 million in economic impact annually.
Supporters of continued access state that closing the area to vehicles would cause long-term economic damage to south San Luis Obispo County.
The current state court action follows prior federal legal disputes involving protection efforts for the western snowy plover and incidental take permits.
By seeking formal intervention, Friends of Oceano Dunes aims to gain official party status to participate directly in court proceedings and oppose restrictions on public motorized access.
A ruling from the Superior Court of California on the motion to intervene is anticipated soon.
