An Indiana judge has granted a preliminary injunction, giving Indiana swimmers Owen McDonald and Zalan Sarkany a 5th year of eligibility one day before Indiana starts their swim season.
At the beginning of September, McDonald and Sarkany were part of a lawsuit against the NCAA, seeking an extra year of eligibility after the NCAA passed the five-for-five rule this summer.
That judge granted the athletes, which included a few Indiana football players, a Temporary Restraining Order that gave the athletes eligibility which expired on September 14th.
Since then, the athletes had been waiting for the court to rule in their case.
On Wednesday, Monroe Circuit Court Judge Kara Krothe granted a preliminary injunction that ruled the athletes could take a fifth year, stating, “Under the plain terms of the 2026-27 NCAA Manual, they are elibile to compete, and the NCAA is breaching its contractual obligations by denying them that opportunity.”
The NCAA will likely appeal this decision, but the results of that appeal will not come before Indiana’s first swim meet tomorrow.
The Hoosiers will open their 2026-2027 season tomorrow, Thursday, September 24th at the inaugural College Swim League match against Michigan, Ohio State, and Louisville.
McDonald and Sarkany were both major players on Indiana’s roster last season, with McDonald scoring 30.5 points and Sarkany scoring 39 points at the 2026 NCAA Championships.
It is not clear if the two athletes will be racing tomorrow, but they are now eligible.
