The Bombay High Court jokingly used the term "non-vegetarian tea", but the issue is serious for one of the most prominent cricket associations, the Mumbai Cricket Association (MCA). The Court mentioned non-vegetarian tea to address the food quality inside MCA at the Bandra-Kurla Complex (BKC).
The Maharashtra Food and Drug Administration (FDA) raised the red flags when it went to inspect the quality of food inside the Complex. Lack of food quality and hygiene raised serious issues against the state cricket governing bodies. Licences of five food vendors were therefore cancelled already.
Bombay High Court's Division Bench with Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad directed the Maharashtra Food and Drug Administration to conduct a fresh inspection of the food and drink outlets located inside the complex. According to FDA, the food outlets in the complex were run by another entity, M/s Shirke Infrastructure, despite the licenses being issued in the MCA's name.
On the other side, to defend themselves, MCA claimed that the actions taken against them by FDA were drastic and arbitrary. Senior counsel Vikram Nankani, who was standing for MCA, asked the court that instead of taking direct action against the eateries, FDA should have issued an early notice so at least they could try to improve the quality of the services.
Court overrules MCA's arguments
The court,t however, rejected the plea by stating FDA sanctioned the actions alleging "gross violation" of hygiene standards during their inspection of the premises.
"As per the FDA's inspection report, the eateries' kitchens were infested with cockroaches and flies, and the floor was slippery and dirty. If there is a gross violation of hygiene standards, then the FDA can decide to suspend the license forthwith," the court noted.
During the hearing, Acting Chief Justice Ghuge, in a sense of joking, commented that there were flies and cockroaches in the restaurants' kitchens. So the tea they used to serve was non-vegetarian tea.

Bombay High Court lauded FDA's swift act against the food outlets
The court lauded the FDA's act during the hearing. In the order, the court also mentioned that the suspension order needs to be on an immediate basis once the restaurants or the food outlets clear up the deficiencies.
"What the FDA is doing is laudable. But once a restaurant/eatery clears up the deficiencies, then the suspension order needs to be revoked immediately. It cannot be kept pending as the FDA's objective has been achieved," it said.
"If this contract is legally permissible, then the FDA shall apply its mind and take a pragmatic approach," the High Court added as the FDA raised issues also in the paperworks
The next hearing of the case is scheduled for August 29 this year.
