"There can be no dispute that the plaintiff's stature inherently grants him proprietary rights over his personality and associated attributes and gives him the exclusive rights to use the personality attributes for commercial purposes and consequently, the right to protect various attributes of his persona from unauthorized use or exploitation by third parties," according to the court order.
"The contents of the impugned AI-generated posts and deepfake videos are tarnishing the immense goodwill and reputation of the plaintiff, garnered over the years with hard work and stellar performances in the field of cricket as well as his contribution to social welfare and lowering his image and standing in the eyes of the public."
Several public figures have already protected their personality rights
Before Yuvraj, other well-known personalities went out of the courts to protect their personality rights. Aishwarya Rai Bachchan, Abhishek Bachchan and Salman Khan, Art of Living founder Sri Sri Ravi Shankar, journalist Sudhir Chaudhary, podcaster Raj Shamani, Andhra Pradesh Deputy Chief Minister Pawan Kalyan and cricketer Abhishek Sharma were among the public figures who were previously relieved by the court.
While approaching the court, Yuvraj alleged that his personality attributes were misused for business purposes. Additionally, he claimed that in several social media posts, his personality was portrayed with misleading and fabricated facts.
In the interim order, the court also directed the removal of all the content across the social media platforms, including the platforms owned by Meta, which positioned Yuvraj in a misleading way.
The order also mentioned that violation of the order will be followed by serious consequences as the privacy rights “need to be dealt with a heavy hand”.
