PEOPLE reports that Paul will get custody of Ever "on the same midweek day each week without overnights as well as alternating weekends." Mortensen remains the "custodial parent" on holidays. The judge also ruled that neither Paul nor Mortensen can make "disparaging remarks of one another" in public and on social media.
“I’m encouraged, and I think we’re moving in the right direction,” a judge said during the virtual hearing, per US Weekly. "From now until the next hearing, I’m going to recommend supervision be lifted."
The next hearing is schedule for July 8.
“I certainly think that both of them have a sense that they are the victims and not the perpetrators and I get that,” the judge added. “The main concern of the court is to prevent further acts of domestic violence and we can have the hope that we see the parents being in the same place getting along but now is not that time.”
Paul and Mortensen have been in a custody battle since earlier this year, when the Salt Lake City police investigated an alleged domestic violence incident. Specifically, Mortensen alleged in court documents that Paul choked him and shoved him into a window during an altercation in February, which led to him fearing for his son's safety. Paul has denied the allegations of child abuse.
During that time, Mortensen filed for custody of Ever, and a judge granted it, as well as giving him a protective order against Paul. A month later, Paul was granted supervised time with Ever for eight hours per week in April. The two have also been ordered to stay 100 feet away from each other for three years.
