UTICA, N.Y. — A former Marcy Corrections Officer who pleaded guilty to reckless endangerment for the death of inmate Robert Brooks still remains a free man.
News10NBC’s affiliate in Syracuse reports Michael Fisher was sentenced to six months in jail Friday, but isn’t behind bars just yet. Fisher won’t be in jail until a decision is made on his currently pending appeal.
Fisher was originally charged with manslaughter for the death of Brooks in December 2024. But on Jan. 16, Fisher took an unexpected plea deal.
After five days of the trail, the jury couldn’t come to a verdict and entered a deadlock. Fisher and his defense were offered the plea deal by Special Prosecutor Onondaga County District Attorney William Fitzpatrick to guarantee at least some jailtime for Brooks’ death.
If Fisher was convicted, he could’ve been sentenced to up to 15 years in prison.
Ten former guards were indicted in Brooks’ case. One of them, David Kingsley, was found guilty of murder and sentenced to 25 years to life in prison.
Four others were sentenced on manslaughter charges, and two were acquitted.
Brooks was serving a 12-year sentence at Marcy for assault after he was convicted of stabbing his girlfriend. Bodycam video showed several corrections officers beating Brooks in a medical exam room. Brooks died in the hospital the next day. Brooks was set to be released in 2026.
