After Elleshia Seymour fled the United States with her four kids in November 2025, her ex-husband, Kendall Seymour, has revealed that the children were located in an orphanage in Croatia. Now that the kids have been found, an attorney explained the next steps Kendall will have to take in order to get his kids back while exclusively speaking to Us Weekly.

In a GoFundMe update on Sunday, January 25, Kendall explained that he was raising money to “hire Croatian lawyers who specialize in child abduction, create and submit Hague Convention applications [and] hire court-approved translators.”

    The Hague Convention is an international agreement to safeguard intercountry adoptions, according to the US Department of State’s website.

    Anthony G. Joseph from Masters Law Group – who is not licensed in Croatia – explained that Kendall’s “first step” should be to retain “a Croatian attorney to advise [him] on these issues.”

    After noting that the Hague Convention process can be “confusing,” Joseph explained that the process is different in every country. In the United States, people have to fill out an application on the State Department’s website and may have to wait a long time to hear back.

    When it comes to Seymour’s case, Joseph said he should “contact a lawyer who can advise [him] as to these issues” because “every country handles and interprets Hague Convention matters differently.”

    Joseph also explained what the Hague Convention process looks like in the United States. “Most people think you fill out an application on the Croatian website, and it gets transferred to the US State Department, and they’re going to send the parent a letter, right? And they’re going to say, ‘Hi, we’re the State Department. We received this application. Please return the child by such and such [a] date.’ That date’s either going to come or go, and the child’s not going to be returned,” Joseph said.

    “They’re then going to send the letter back to their foreign counterparts saying, ‘Look, we were attempting to reach out to said parent [and they] didn’t return our phone calls. So therefore, here’s a list of lawyers who could possibly help you,’” the attorney explained.

    After Elleshia, 35, was last seen getting on a plane to Europe with her 11-year-old, 8-year-old, 7-year-old and 3-year-old children in November 2025, an Endangered Missing Advisory was issued for the children on December 10, 2025, and Elleshia was charged with four counts of felony custodial interference.

    Kendall shared via the GoFundMe page that the kids were located, explaining that they are “trapped in Croatia in a state-run orphanage.” He added, “We are in the country, trying to get the kids out of the custody of the local government.”

    He also shared that a “fifth American child” is in the orphanage where his kids are. “My children were traveling with him and his mother. The fifth child’s situation is even more difficult than my own kids’ status,” Kendall continued on the GoFundMe page. “We would like to help him as much as possible – his situation is going to need more legal help and strategy than ours.”

    The Salt Lake County District Attorney’s Office has since confirmed that Seymour was taken into custody on Friday, January 16, in Dubrovnik, Croatia.
