Egypt’s Education Minister faces potential imprisonment and removal from office

The New Cairo Summary Court is scheduled to hear a criminal lawsuit on May 13 filed against the Minister of Education, Mohamed Abdel-Latif. The Minister stands accused of intentionally failing to implement a final and enforceable judicial ruling. The lawsuit seeks his imprisonment and removal from office, as well as one million Egyptian pounds in civil compensation.

The Public Prosecution referred the Minister to trial following a direct criminal action brought by Amr Abdel-Salam, a lawyer at the Court of Cassation. Abdel-Salam is acting on behalf of the owners of a school in Minya Governorate, which had been leased by the Ministry of Education.

    The case dates back to a final ruling issued by the Minya Primary Court. That verdict ordered the Minister of Education, in his official capacity, to vacate the school premises and return the property to its owners. This ruling was subsequently upheld by the Beni Suef Court of Appeals, which dismissed the Ministry’s appeal and confirmed the original judgment.

    According to the new lawsuit, the Minister of Education has refused to return the school to its owners without any legal justification. This led the owners’ lawyer to send a formal legal notice to the Minister’s residence in New Cairo. The notice demanded that the court ruling be followed immediately and warned that if the Minister continued to ignore the order, he would face criminal charges.

    The lawsuit claims that the Minister is fully aware of the court’s decision but has deliberately chosen not to act. Subsequently, the owners have turned to the criminal justice system. They are relying on Article 123 of the Penal Code, which makes it a crime for a public official to intentionally block the enforcement of a court ruling.

    The case’s legal trajectory shows that the original verdict was confirmed by an appeals court as far back as 2016. The Ministry tried to pause the eviction by filing a legal challenge (an objection to execution), but the court rejected their attempt and even fined the Ministry for the delay.

    Most recently, on December 24, 2025, the owners gave the Minister a final eight-day grace period to comply with the law. Despite this formal warning, the Minister has still not handed over the school.
