March 11 preliminary hearing set in downtown homicide case

A judge has set a preliminary hearing for March 11 for a man charged with homicide in the slaying of a man downtown that occurred on Aug. 3.

Brian Keith Tyner, 37, waived his right to have a speedy hearing in the shooting death of Antwan Eugene Bluthenthal, 46, who was shot on the third floor in a building at G Street and Sixth Avenue.

    Both Tyner and Bluthenthal visited the Cielo Rooftop Lounge on the fifth floor and later encountered each other on the third floor. Attorneys have not discussed what led up to the shooting.

    The Cielo Rooftop Lounge said it was cooperating with police.

    Bluthenthal worked in the Veterans’ Administration hospital as a respiratory technician and was the father of an infant daughter.

    Tyner appeared Dec. 2 before San Diego Superior Court Judge Dwayne Moring after changing attorneys, with Oscar Valencia stepping up to represent him.

    Tyner also pleaded not guilty to carrying a concealed weapon. If convicted of first-degree homicide, he faces a sentence of 25 years to life in prison.

    He remains in jail without bail.
