Catastrophic injuries: Family suing truck company, driver after I-35 bridge crash

GEORGETOWN, Texas (KXAN)—Jonathon Scott Morgan spent his 42nd birthday in the ICU, fighting for his life, after being struck by concrete when a bridge collapsed as he was driving under it last week, according to his attorney.

Kimberly Kayatta, with Tinsman & Sciano, said Morgan's family hired their team to seek legal action against the truck company Austin Underground Incorporated and the truck-tractor/trailer operator, accused of crashing into an overpass bridge on Interstate 35 in Georgetown on Sept. 2.

    "This is a personal injury lawsuit arising out of the negligent and grossly negligentuse, operation, inspection, and maintenance of commercial motor vehicle that resulted in aviolent preventable collision that occurred on or about September 2, 2025, in WilliamsonCounty, Texas as a result of the negligence and gross negligence of the Defendants whichproximately caused permanent, life-altering, catastrophic, and severe personal physical injuries and damages to Plaintiff Jonathon Scott Morgan," the lawsuit filed on Friday states.

    Kayatta told KXAN Morgan was struck directly by concrete as the truck crashed into the overpass.

    "When it [the truck] struck the bridge, it actually caused a lot of that building material to fly off, and one large concrete chunk actually came through Mr. Morgan's windshield, and there's a gigantic hole in his windshield, and struck him directly while he was driving, and it caused him to lose control of his vehicle," Kayatta said.

    KXAN has reached out to Austin Underground, and no attorney was listed for the company. We will update this story if a comment or statement is received.

    Morgan remains in the hospital, as of Monday, Kayatta said. The family has asked for privacy.
