The city will hold a public hearing on Tuesday to determine whether residents have the legal authority to repeal a council-approved ordinance, following a protest filed against an issue committee.

The Greeley Deserves Better issue committee has been engaged in many battles since turning in 8,993 signatures on Aug. 6, with only 5,538 being valid. However, its biggest challenge will take place on Tuesday at a hearing set by the city in response to a protest challenging the legality of the issue committee’s actions. Former Greeley city manager Leonard Wiest, along with Tom Hacker, John DeWitt and Zach Bliven, filed the complaint.

    The committee seeks to repeal ordinance 2025-15, which approved collateralizing 46 city buildings, including City Hall, fire and police stations and others, to secure a $115 million loan, or Certificate of Participation, for predevelopment work on the Catalyst project, an entertainment district being developed in west Greeley.

    On Tuesday, the city council added the Union Colony Civic Center to that list because City Center North was ineligible to use in this instance, as it is part of the 2016 Certificates of Participation that funded the construction of City Center South, according to Chief Financial Officer Allena Portis. This brings the total buildings that have been added as collateral to 47.

    Greeley Forward, a pro-Catalyst issue committee that has filed a campaign finance complaint against Greeley Deserves Better, was unavailable for comment before the Tribune’s deadline. The city clerk recently verified the complaint and sent it to the Colorado Secretary of State for further investigation.

    The hearing officer will make their determination on the issue before Aug. 31. Should the officer determine that the issue committee’s efforts violate Colorado law, the measure will be blocked from going to the ballot.

    If it is found not to be against the law, the issue will go before the city council during their regular public meeting on Tuesday, Sept. 2 for the council to decide whether to place the issue on the ballot or repeal the ordinance themselves.

    Tuesday’s hearing will be open to the public, but city staff has warned that there will only be space for 15 people, and the hearing officer requested that the city not stream the event.
