(KRON) -- A man who served jail time last month for drunk driving is accused of driving into an elderly man and his dog in Atherton on Friday and fleeing the scene. Boe, the Bernese mountain dog, was killed in the collision, according to the San Mateo County District Attorney’s Office.
Lucio Villagomez Sosa, 71, of Redwood City, pleaded not guilty on Tuesday to hit-and-run causing injury, hit-and-run resulting in property damage, driving while privilege is suspended for DUI and driving while privilege is suspended for failing a blood alcohol test.
The victim was walking his dog, Boe, at 7:40 a.m. when he was crossing El Camino Real at Selby Lane inside the crosswalk. The dogwalker “saw a green Ford van traveling at a high rate of speed towards him and realized the vehicle was not going to stop,” prosecutors wrote.

The van, allegedly being driven by Sosa, did not stop after the collision and fled the area.
“The hit and run was caught on video and police were able to investigate and find the defendant,” the DA’s office wrote. According to prosecutors, Sosa admitted to driving the green van and fled because he was scared.
Court records show Sosa had been sentenced to 10 days in jail on July 11 after pleading no contest to drunk driving.
Sosa was released by the court Tuesday on the condition of not driving any motor vehicle. He is scheduled to return to court on Oct. 13 for a preliminary hearing.
