New Delhi:  A plea has been filed before the Supreme Court challenging the Central government rules empowering it to prescribe a range of rates for medical procedures and services which private hospitals and nursing homes can charge. The plea challenges the validity of Rule 9(ii) of the Clinical Establishments (Central Government) Rules, 2012 as being manifestly arbitrary, irrational and unconstitutional, violative of Article 14, Article 19(l)(g) and Article 21 of the Constitution. “The Impugned Rule is also ultra vires the principal Act, namely the Clinical Establishments (Registration and Regulation) Act, 2010 insofar as the Parent Act does not confer power on the Respondent (authorities)
