ALBANY, N.Y. — A federal judge has denied a request by 15 sheriffs, including the Wayne County sheriff, to block a New York State law that bans law enforcement from making agreements with federal immigration agents.
The sheriffs filed a lawsuit against Gov. Kathy Hochul’s administration in August over the “Local Cops, Local Crimes” Act. Wayne County Sheriff Robert Milby told News10NBC that he joined the lawsuit because he believes the law violates his independence as an elected sheriff.
U.S. District Judge Mae D’Agostino denied the sheriffs’ request for a temporary injunction, but the lawsuit itself can continue. The ruling says New York generally does not allow local government entities or their officers to sue the state over state laws, except in narrow situations. According to the judge, the sheriffs’ lawsuit didn’t fit those exceptions.
“The Court has reviewed the cases cited by the parties, and, of course, conducted its own research,” the judge wrote. “In doing so, the Court has not found a case which supports Plaintiffs’ capacity to sue New York, its Governor, or its Attorney General for the alleged constitutional violations.”
