ITHACA, N.Y. — NBC News has obtained the six-page statement that a Cornell University student gave to campus police in 2024, alleging that multiple students gang raped her at an on-campus fraternity house.

In the statement, she told Cornell University Police that she initially agreed to a sexual encounter with two of the men, but then more men walked into the room. She also said she was unable to make any of her own decisions that night because of how intoxicated she was.

The student also filed a lawsuit alleging gang rape, saying that seven other students sexually assaulted her at the Chi Pi fraternity house after being plied with alcohol and drugs. News10NBC confirmed through the details in the lawsuit that one of the defendants is from Canandaigua.

Statement to police

The student described going to two different Ithaca bars that evening, then going to the Chi Phi fraternity house around 10:30 or 11 p.m. to meet a friend. She told police that she initially agreed to a threesome, but at one point “multiple men walked into the room,” and she was “instantly horrified.”

According to her statement, she ran across the room to hide under the covers of another bed, which she said felt like the only option because the men were standing between her and the exit. In her statement, she said she turned the men down repeatedly, expressing discomfort and feeling coerced.

The student said that the next day, she realized that what happened to her was being talked about on campus. “It was made clear to me by several friends that the members of Chi Phi were bragging,” she told police. She added that “it was now obvious that everyone knew it was me that this had happened to.”

The student said the encounter happened on the night of Oct. 19 to 20. She gave the statement to campus police on Nov. 14, 2024, 26 days after the alleged assault.

The student filed the lawsuit on Sept. 16 of this year, saying she was pressured to snort ketamine, smoke marijuana, and drink alcohol — soon becoming incapacitated when the alleged gang rape ensued. The woman is suing the former students, the Chi Phi fraternity, the university, an Ithaca bar, and others, seeking undisclosed damages.

Tompkins County District Attorney Matthew Van Houten has reopened the investigation into the case. The university said in a statement that it supports the decision to reopen the investigation. The school said it conducted its own investigation and issued sanctions, including expelling some students and suspending others. It also said the on-campus Chi Phi chapter was closed in 2024 and remains barred from campus.
