Neighbors are upset over what they argue is a restriction of public access to the lakefront in Cedar Lake, Indiana, about an hour south of Chicago.
Homeowners say the town has reduced lake access due to new developments in the area, and they are demanding to know why.
“This lakefront means a lot to us. I know my kids enjoy this every summer going down here and it does seem like more and more of it’s being taken away,” said homeowner Luke O’Connell.
Neighbors worry about safety walking to the lakefront because they say the only road to the lake has narrowed to 20 feet across – half of what they argue it should be.
“This is our last access point for the 90 homeowners that don’t live on the lakefront to be able to get down to use the lake,” said Terry Cox, President of the Lake Shore Subdivision Association.
The LSSA says it’s suing the town of Cedar Lake to restore the public right of way.
“All of this is supposed to be for people to be able to get down to the lakefront. It’s a public right of way,” Cox said.
Besides the lawsuit against the town, the LSSA is also demanding an immediate stop-work order to new home construction along the road.
“You’re allowing like four or five homeowners everything they want when you’ve got 90-something homeowners saying ‘don’t do it,'” Cox said.
The LSSA also says it is filing formal complaints with the Indiana Public Access Counselor, Lake County Planning & Zoning, and the Indiana Attorney General.
“If the town would just follow the rules they’re supposed to follow, there would be none of this – nobody would have any problems with it. Just leave our access alone,” said homeowner Becky Davis.
NBC 5 reached out to Cedar Lake town officials for a response but we have yet to hear back.
“We just really would like it, you know, people to follow the rules and to be able to enjoy this beautiful lake that we have,” said homeowner Lacey Ambroso.
