On May 11th, the Aquatics Integrity Unit announced they were imposing a two-and-a-half year suspension on Mykola Zuban, a Ukrainian Physiotherapist.
The organization said he violated Article 4.1.7 of the World Aquatics Rules on Protection from Harassment and Abuse, and he violated Articles 5.1, 5.3, and 5.5 of the World Aquatics Integrity Code.
Article 4.1.7 of the World Aquatics Rules on Protection From Harassment and Abuse is the “Sexual Abuse” section and states:
“Any conduct of sexual nature, whether non-contact, contact or penetrative, where consent is coerced/manipulated or is not or cannot be given.”
In the World Aquatics Integrity Code, Article 5 is titled “Duties of Good Conduct”
“5.1 Covered Persons must always act honestly, fairly, impartially and in accordance with the highest ethical standards of integrity and transparency.
5.3 Covered Persons must avoid acts or omissions that give the appearance of impropriety, or that disparage World Aquatics, or that bring (or have the potential to bring) World Aquatics, Aquatics and/or sport generally into disrepute.
5.5 Covered Persons must not be involved with entities or persons whose activities or reputations are inconsistent with the principles set out in this Integrity Code. In order for this provision to apply, it is necessary that the Covered Person has previously been advised in writing by World Aquatics, a Continental Organisation, a World Aquatics Member, or other relevant authority with jurisdiction over the Covered Person that there should be no more association with such entity/person, and of the consequences that will apply if any association continues.”
The AQUI stated that his suspension will run until November 5, 2028, and the sanction also includes a suspended period of one and a half years which “will only be enforced if he commits another violation of any World Aquatics rules within four years”.
During his suspension he will not be eligible to hold “any position within World Aquatics, any World Aquatics Continental Organization, or any World Aquatics Member Federation, including affiliated clubs or recognised bodies.”
Zuban particularly worked with the Ukrainian Artistic Swimming team. He was also a massage therapist on the Ukrainian National Biathlon Team for the 2014 Sochi Olympics.
