Attorneys heard a stunning mea culpa from the U.S. Attorney’s Office of Northern Illinois after prosecutors dropped all charges against the so-called “Broadview Six” immigration protesters.
The reason? Prosecutors admit they made significant mistakes.
However, attorneys for the defendants in the case claim these ‘errors’ were not mistakes at all, but rather intentional misconduct on the part of prosecutors in order to tip the scales to get an indictment.
The even say the alleged cover up might be even worse, and now a judge says prosecutors might even face sanctions.
“Today, we have won in court, and we will continue to stand up against injustice,” said Oak Park village trustee Brian straw, who was charged as part of the case along with five others.
Straw, former Congressional candidate Kat Abugazalah and four others were indicted after allegedly blocking federal vehicles outside the Broadview ICE facility in September 2025.
U.S. Attorney Andrew Boutros took the extraordinary step to dismiss the charges himself in court before federal Judge April Perry, and he admittedit was because prosecutors botched the grand jury process.
“It is my very sincere belief that no prosecutor acted intentionally in misleading you,” Boutros told the judge.
What were the errors? Unsealed court documents reveal a grand juror was kicked off for disagreeing and a prosecutor communicated with a juror outside court, among other issues.
“I’m sick to my stomach as a former prosecutor,” said Straw’s attorney Chris Parente, who spent weeks fighting for the release of transcripts of secretive grand jury proceedings in court. “I’m sick as a U.S. citizen who has to live in this country under this Department of Justice that is acting this recklessly.”
But there’s more: Boutros admits transcripts of the grand jury testimony were submitted to the judge heavily redacted, with entire pages highlighting the errors missing. Defense attorneys allege it wasn’t an accident.
“It is a cover up, what is happening. And it is a cover up that continued today,” said defense attorney Josh Herman.
Boutros rejected that argument.
“I do not believe any errors as it relates to redactions were done intentionally,” he said. “We stand behind the charges that we were prepared to bring but when we became aware of the conduct in the grand jury, we corrected it by dismissing the indictment immediately.
Perry admonished Boutros in court.
“You are significantly undercutting your mea culpa by standing by charges and continuing to vilify these particular defendants,” she said.
Defense attorneys now say prosecutors should face sanctions for their errors, and they have vowed a further investigation to get to the bottom of what went on behind closed doors in the grand jury room.
