ROCHESTER, N.Y. — Jury deliberations started this afternoon in the trial of Jamie Busch, who is accused of killing her sister Penny Busch and hiding her body in the fall of 2024. News10NBC’s Erin Mahon was at the Hall of Justice to hear the closing arguments.
The defense directed the jury’s attention toward Penny’s daughter, Samantha, instead of Jamie. The defense cited handwritten notes Penny wrote a month from her death that included sentences like, “I am terrified. I am exhausted. I am no match for my daughter.”
Jamie’s attorney also argued there were innocent explanations for the evidence, including Jamie’s search history with entries like “how to manufacture a good alibi” and “how to get rid of a body.”
The defense said these searches were a result of Jamie “going down the rabbit hole” after Penny went missing.
Assistant District Attorney Jessica Wagner reminded the jury that Samantha had an alibi, as she was in South Carolina the weekend Penny disappeared and died. Uber receipts and photos with time stamps and geographic data show Samantha’s location in Myrtle Beach, South Carolina. Wagner urged the jury to use common sense when considering the search history evidence.
“And then what came from her cell phone. I mean she’s googling how to dispose of evidence, how long evidence lasts, how to get to and from the Lehigh Valley Trail. That in my opinion was incredibly, incredibly powerful,” said Wagner.
Members of Penny’s family were present in court, visibly emotional when a photo of Penny’s body was shown. The image depicted Penny wearing the same sweater on Oct. 14 as the one she wore in Walmart on Oct. 8.
Mahon approached the family after court, but they chose not to comment. A family friend confirmed their identity, and Mahon respected their decision to remain silent.
Jury deliberations ended just before 5 o’clock tonight and resume at 9:30 tomorrow morning.
