BATAVIA, N.Y. — A Batavia man accepted a plea deal in connection with a February apartment fire that killed a 10-year-old boy and injured two other children.

Henry Banks entered an Alford plea in Genesee County Court, meaning he pleaded guilty without admitting fault.

Police said Javarious Williams and two other children were left alone in the Vine Street apartment when the fire started, resulting in Javarious’s death. Banks faced charges of criminally negligent homicide and child endangerment.

As part of the plea deal, Banks will be on probation for one year. If he successfully completes probation, he can withdraw his plea and face only misdemeanor charges without jail time.

“It’s a terrible thing to lose a child. But we can’t be driven by the results, we have to be driven by what’s just,” said Kevin Finnell.

Final sentencing is scheduled for October of next year.
