Kristina Paegle and Levi Sandidge have been ruled eligible once again as the two are part of a lawsuit in Kentucky for an NCAA fifth year. Earlier this month, the Kentucky Court of Appeals ruled the 38 athletes in the lawsuit ineligible.
The two are a part of Wells vs. NCAA that was filed in Kentucky. That lawsuit was originally filed in the middle of August before more athletes added their names to the lawsuit at the start of September. The lawsuit aimed to grandfather them into the NCAA’s five-for-five eligibility model, giving athletes who graduated this past season another year of eligibility. On October 2nd, the NCAA won its appeal. Today, October 16th, a new temporary injunction has ruled the athletes eligible once again.
Paegle spent her undergraduate career at Indiana and swam for the program at March #1 of the College Swimming League (CSL) as that meet was before the court of appeals ruling. Paegle is also competing for the Hoosiers at their 2nd CSL match (Match #5) which is taking place tonight.
Paegle is also a member of the lawsuit in Indiana alongside men’s teammates Zalan Sarkany and Owen McDonald. Owen McDonald is swimming in CSL Match #5 but did not swim in Match #1.
Kentucky did not have a meet scheduled for September so Sandidge has not been eligible for the Wildcats yet. He did not swim in the team’s meet today against Auburn in the Dual Meet Tournament that is taking place at Georgia Tech. That meet began at 6 pm ET tonight.
