Family considers legal action after woman struck, killed by cement truck driver

At 71, she never stopped working or learning, but a few weeks ago, Ann Marie LoPrieno’s life came to a tragic end.

After her death, her family is considering legal action.

LoPrieno was walking to Courageous Bakery in suburban Oak Park on the morning of September 23 when she was hit by the driver of a concrete truck.

It happened as she was crossing the street at North Boulevard and Euclid Avenue, right outside the Oak Park Fire Department, according to authorities.

The village says the driver was coming from a job site on Oak Park Avenue and remained at the scene. He was given a citation for failure to yield to a pedestrian. He’s due in court later this month.

As that court appearance nears, the family is seeking justice.

“Based on the video footage that I’ve seen, this incident never should have happened under any circumstances,” said Atty. Louis Anthony Cairo with GWC Law. “My client is a 71-year-old who walks with a cane, and you see her trying to run for her life at 71 years old, and then tragically gets ran over by the cement truck. So, our objective is to hold everybody accountable.”

The village in a statement says while there hasn’t been a stop-work order in the area around where the collision occurred, they are still committed to improving pedestrian safety.

    Here is the village’s statement:

“While there have been no specific changes made at this time, pedestrian safety remains a priority, and we are always looking for ways to improve it.The Village is committed to the goal of consistently having zero deaths or serious injuries on its streets by 2035. The Vision Zero plan details the approach for how the community will get there together and is guided by data and informed by the lived experiences of people throughout Oak Park. The plan includes strategies and recommended actions, community testimony and input, and a toolbox.”

As the legal case continues to unfold, those who remember LoPrieno are mourning her loss.

“She comes in every day,” Haylee Johnson, one of the managers at Courageous Bakery. “All our baristas know her by name. She brought warmth, she brought love every time she walked through that door. The construction has been going on since last December, and it has impacted a lot of people and businesses,” Johnson said. “And there are lots of construction trucks coming through.”

LoPrieno was working on her Ph.D at Trident University International, which will now be awarded to her posthumously.

“She never went anywhere without a backpack, and she always had to have a minimum of three books,” said her sister-in-law Patricia. “She had at least 25 backpacks. We donated those to a shelter in Elgin.”
