The International Criminal Court (ICC) condemned USsanctions against the court, describing them as an “attack on the rule of law.”
In a statement, the ICC said the sanctions undermined thefoundations of the international legal order and challenged the principle thatno one is above the law. “History will judge this moment,” the court added.
The ICC said the measures were intended to intimidate itsstaff and obstruct its work, adding that it would not allow anything to deterit from fulfilling its mandate.
ICC President Tomoko Akane said the court would continuecarrying out its mandate independently and impartially, relying exclusively onthe law and evidence and acting in the interests of the countless victims ofserious crimes.
The court also called on its 125 member states to supportit, warning that its future depended in part on the countries that hadestablished it. It added that future generations, particularly victims of massatrocities, would question how the international community responded when aninstitution created to protect them came under attack.
Stéphane Dujarric, Spokesman for the UN Secretary-General,condemned the US sanctions, saying the Secretary-General is deeply alarmed bythe expected impact of today’s sanctions on the International Criminal Court asa whole, and in particular, its continued ability to perform its importantmandates, including in relation to the situations referred to it by theSecurity Council and States Parties to the Rome Statute.
“Today’s decision marks a serious blow to our collectivepursuit of international criminal justice, of which the ICC is a key pillar, headded, stressing that accountability for international crimes and delivery ofjustice to victims are central “to our global commitment to peace, security,human rights and fundamental freedoms. “
UN High Commissioner for Human Rights Volker Turk alsocondemned the sanctions, describing them as “unacceptable” and calling forimmediate measures to protect the ICC and those cooperating with it.
“These sanctions, the latest in a series of retaliatorysteps against the ICC and its personnel for the work they do every day toadvance accountability for the very worst violations of human rights, areunacceptable,” Turk said.
The European Union described the US measures as deeplyregrettable and said it was prepared to take any necessary steps to ensure thecourt could continue operating effectively.
The European Commission said it would work closely with theICC to safeguard its operations, expressing hope that the six-month periodbefore the sanctions take effect would leave room for dialogue.
Norwegian Foreign Minister Espen Barth Eide said thesanctions were a matter of serious concern. He added that Norway and othercountries were assessing how best to support and protect the court and whetherthe sanctions could be prevented from taking effect.
Belgian Foreign Minister Maxime Prevot strongly condemnedthe measures, warning that efforts to obstruct the court would deprive victimsof a path to justice and allow perpetrators of the gravest crimes to escapeaccountability.
Prevot said Belgium had called for the European Union toactivate its “Blocking Statute,” a mechanism intended to protect Europeanentities from complying with certain foreign sanctions.
By contrast, Israeli Prime Minister Benjamin Netanyahupraised US President Donald Trump and Secretary of State Marco Rubio forimposing the sanctions.
In a statement issued by his office, Netanyahu described theICC as a “political body” that posed an existential threat to democracies thatuphold the rule of law and to the principle of national sovereignty.
