Cornell controversy renews focus on Loyola University sexual assault lawsuit

The Cornell University case is reigniting conversations about a lawsuit filed against Loyola University in 2022. Ten young women say they were all sexually assaulted when they were Loyola students.

NBC 5 Investigates has followed the case since these women first sued Loyola University. Now, with Cornell in the spotlight, some of these young women are asking their attorney for updates in their case.

Jane Doe G, as she is named in the lawsuit, said she hopes the stories force change on college campuses.

“I start having anxiety like as soon as the weather changes and it’s fall, because my incident occurred in fall,” Jane Doe G told NBC 5 Investigates.

The changing of the leaves takes Jane Doe G back to her freshman year and the fear that followed.

“I wasn’t a one-off case. I was a victim of a serial assaulter at Loyola, and I wasn’t the first victim,” she said.

“Do you think the university could have prevented your sexual assault?” NBC 5’s Rose Schmidt asked Jane Doe G.

“I do because my assault happened on campus in one of the residential buildings that this individual was living in, and I think that had they paid attention and had they taken the previous report seriously, that this individual wouldn’t have been on campus to begin with for my situation to occur,” she said.

Court documents detail that alleged assault from November 2019. She confided in her professor, who filed a Title IX complaint on her behalf. Loyola officials later told her at least five other victims had reported the same assailant, according to the complaint.

“I couldn’t believe the like atrocious mentality that the perpetrator held to be able to do that. But I also couldn’t understand why the university hadn’t done something about it earlier,” she said.

She alleges in the lawsuit the Title IX office discouraged her from speaking with an attorney or police, but she did eventually join a lawsuit with nine other former students.

NBC 5 Investigates repeatedly requested comment from Loyola University but has not heard back.

Loyola’s attempts to dismiss the lawsuit have been denied in court, and previously, a spokesperson told NBC 5 Investigates the university doesn’t comment on pending litigation. The lawsuit is still going on four years after it was initially filed. The young women are seeking their tutition fees refunded, among other damages. A trial date is set for September 2027.

Ashley Pileika, an attorney from the Law Office of Darren Wolf, is representing the young women.

“Their parents sent them to Loyola based on Loyola’s promises, policies, procedures that they would be kept safe on their campus, that they will be able to obtain an education. That’s what they paid for and they did not receive that,” Pileika said.

The lawsuit alleges Loyola systemically mishandled and underreported student complaints of sexual misconduct dating back to 2011.

“I would really urge donors, alumni, before writing another check to ask them, ‘What are you doing to keep students safe on your campus?'” Pileika said.

Court documents allege when Jane Doe G learned she’d be in class with her assailant the next semester, Loyola officials said they couldn’t “force” him out of the class, and instead, she herself should contact the assailant and ask him to pick a different class.

“They were very adamant about … ‘You’re saying that this happened to you, but he is also a student, so we have to make sure that we are also protecting him,'” Jane Doe G said.

A first-generation college student, she chose Loyola for its Jesuit values and focus on social justice. But her alleged assault altered her future plans, and the university’s response destroyed her trust.

“I felt that that experience (with the Title IX office) was equally traumatizing, if not more, than the assault itself,” Jane Doe G said.
