Equity Demands That NCDs Be Part of LUMO Rewriting

Madame Mayor, You recently advised my neighbors and me that “we’re weighing real trade-offs here — occupancy, affordability, enforcement capacity — with an eye to the health and well-being of the whole community, not just the neighborhoods closest to campus.” In light of that, I would be grateful if you would address the issue of why Neighborhood Conservation Districts (NCDs) are excluded from the changes proposed in the new LUMO which would allow duplexes, triplexes, and four-plexes (DTFPs) to be built in single family residential neighborhoods. Virtually all NCDs ban DTFPs in one way or another. The desire to limit development in these neighborhoods to single family structures was the primary motivation in the formation of each. It is clear that the residents who were willing to invest the time and money to achieve these results are the most ardent opponents of the introduction of DTFPs into existing single family neighborhoods. To allow these islands of exclusivity to persist, given you’re statement above, is clearly unfair and unequal treatment of unprotected neighborhoods. The choice to protect the NCDs from DTFP development could also be seen as an attempt to keep a vocal and motivated group of citizens who would oppose DTFPs from taking part in the current discussion. Divide and conquer if you will. Taking up the issue of NCDs at a later date is patently unfair to other town residents. There will be little motivation for non-NCD residents to push this issue once LUMO changes have become law. A sizable and motivated majority of NCD residents do and will oppose DTFPs. It should be noted that almost half of the members of this Town Council live in these protected NCDs and peer pressure to maintain the NCD’s unique protections will be intense. If you honestly want to treat all residents equally and have all bear the same burdens, the NCDs must be included as part of this LUMO re-writing. If it takes more time, so be it. There is no rush and no deadline other than an arbitrary one of your own (or the Staff’s) making. It’s said that a leader of character, when asking a group of followers to make a sacrifice, says “Let me be first.” Your actions on this issue will demonstrate if you subscribe to that as well.
