ROCHESTER, N.Y. — A former Waterview nursing home resident says he was kicked out of the facility last week and is now homeless without his critical medication.

News10NBC’s Deanna Dewberry has been investigating Waterview for more than three years. The closure plan approved by the state indicates the facility was supposed to close today, but about 20 residents still have no place to live. The law mandates the facility remain open until every resident has a bed.
Peter Santiago
Peter Santiago ended up at Rochester General Hospital on July 28, 2025 after suffering a major stroke. He was treated there for weeks.
“By rights I should be dead,” Santiago said.
He survived and was transferred to Waterview in August for rehabilitation. Because he’s at high risk for forming blood clots, he takes a blood thinning medication.
Homeless and without medication
“If I don’t get my medication I could have another stroke, or I could have a pulmonary embolism which is a blood clot in the lung,” Santiago said.
But he doesn’t have his medication and he’s now homeless. Santiago says Waterview leaders kicked him out last week after he left on a pass to attend a funeral and was late returning.
“They were waiting for me right in the parking lot and said you can’t come in the building,” Santiago said.
Santiago had a weekend pass that he had requested weeks before. Waterview claimed he had left against medical advice.
Reaction from an attorney
Jeff Neiznanski is an attorney who has represented nursing home residents. He says the state of New York has strict rules surrounding involuntary discharge of a resident.
“It’s not on the list for allowable reasons for discharge,” Neiznanski said.
The notice must be in writing and meet certain legal requirements, Neiznanski said.
“I wasn’t given anything. They didn’t even give me my medication,” Santiago said.
Deanna investigates
Deanna went to the facility to ask if Santiago’s discharge met any of the legal requirements. An administrator would answer none of her questions and kicked her out.
“You can’t just patient dump,” Santiago said.
There are situations in which residents can be immediately discharged if they’re a harm to themselves or others, or they no longer require treatment. But the law mandates that be in writing.
What’s next?
Santiago is now sleeping on a friend’s couch. News10NBC contacted Lifespan about Santiago’s situation and it’s now involved, working to make sure Santiago gets his needed medication.
A spokesperson for the state Department of Health responded by saying:
“We are sympathetic to the resident in question and understand this is a difficult time. The Department will continue to monitor the situation as part of its oversight of the facility’s closure.”
