NEW YORK — The State of New York has reached a settlement agreement with the family of Robert Brooks, the Greece native who was beaten to death by correction officers at Marcy Correctional Facility in 2024.
The family filed a federal civil lawsuit in January 2025, shortly after Robert Brooks’ death. 17 employees at the correctional facility were listed as defendants in the lawsuit.

Brooks died in December 2024, hours after a group of guards beat him inside the prison. His beating was caught on bodycam video. Brooks was serving a 12-year sentence for assault after he was convicted of stabbing his girlfriend. He was set to be released in 2026.
Ten former guards were indicted in Brooks’ case. One of them, David Kingsley, was found guilty of murder and sentenced to 25 years to life in prison.
Four others were sentenced on manslaughter charges, and two were acquitted.
Gov. Hochul statement
On Friday, Gov. Kathy Hochul released a statement in regards to the agreement. She said she hopes this agreement gives them “some measure of relief.”

“No family should ever have to endure what the family of Robert Brooks has been through. The senseless killing of Mr. Brooks by those charged with protecting him horrified us all. While I am grateful for law enforcement and the District Attorney’s efforts to hold the perpetrators accountable, there is nothing that can erase the pain the Brooks family has endured. It is my hope that this agreement will provide them with some measure of relief in the aftermath of his loss.
“Robert Brooks should be alive today. Every individual who enters a DOCCS facility deserves to be safe, and I am committed to continuing to do everything in my power to ensure our correctional facilities are fully reformed and safe for all.
“I want to send a message loud and clear: We have zero tolerance for anyone who violates their oath by committing an act of violence or putting the safety of others at risk.”
Family to respond to settlement Monday
Robert Brooks’ family and their attorneys are expected to hold a press conference Monday, responding to the “historic.” settlement.
