Wendy’s Sued After Allegedly Containing Bacteria Causing Nausea and Diarrhea

A woman is suing Wendy’s after allegedly consuming a double cheeseburger left her in the hospital.

Roxie Ellis Douglas claims the fast-food chain infected her with a bacterial illness after eating their food. She filed the complaint on July 30. She alleges her meal was “not fit” for human consumption, according to the complaint obtained by People.

    The case was filed in the Circuit Court of Cook County, Illinois, but Wendy’s requested that it be transferred to the United States District Court for the Northern District of Illinois on Aug. 20. The company also asked for a trial by jury.

    Douglas claims she had a double cheeseburger meal, which included a double cheeseburger and a baked potato, delivered from a Chicago Wendy’s on Aug. 5, 2025. She stated that the food arrived in a “sealed, unopened bag” and that she ate it at home.

    The plaintiff claimed she then “suffered serious illness and injury” as a “direct and proximate result” of consuming food from the chain. She alleges the meal caused her to suffer from “Campylobacter intestinal infection, acute infectious colitis, leukocytosis, dehydration, gastroenteritis, and hypokalemia secondary to diarrhea.”

    Douglas added that serving Campylobacter- or other bacteria-infected food “is unreasonably dangerous for its ordinary and expected use of human consumption.”

    “Such a food product is thus in an unreasonably dangerous condition not contemplated by an ordinary consumer, making it defective,” she alleged. She claimed the fast-food restaurant did not use ingredients that were safe and “free from adulteration of deathly pathogens.”

    She further alleged that Wendy’s did not use “safe and proper” methods to prepare her meal and failed to give an “adequate warning” about the dangers of consuming the food. She claims the meal was “unreasonably dangerous and in a defective condition.”

    Douglas allegedly has accrued over $93,000 in medical expenses, according to People. These included charges from the Chicago Fire Department/EMS and a Chicago hospital.

    Douglas is suing Wendy’s for damages in excess of $50,000.
