A family is furious after a reported plea deal was offered in the murder of a Simeon High School student 12 years ago.
The family has been waiting for the case to go to trial for more than a decade, and now they said the man charged in the case is receiving a plea deal.
Tymeka Wyndett told NBC Chicago her family is preparing to face her son’s alleged killer in court next week.
“Every time that I get a phone call that a court date is coming it’s like it’s ripping the Band-Aid off. It’s like reliving that moment again,” she said.
She’s recently learned from the Cook County State’s Attorney’s Office that one of the men charged in her son’s murder Kenneth Jackson is being offered a plea deal more than a decade later.
“They’re telling me that they are taking murder one (charges) off the table,” she said. “They’re going to charge him with conspiracy, and they’re offering him 15 years as the plea deal with time served,” she said.
Wyndett said that’s not justice for her son Michael Flournoy, who was killed in 2014.
“You get to come out here and live the rest of your life while me and my family were dealt with a life sentence,” she said. “It’s unacceptable.”
Her son was 16 years old and both a wrestler and football player when investigators said he was jumped, beaten, and shot in the head while walking to get a bag of chips following an argument.
“I just miss him so much,” she cried. “A prosperous, outgoing, loving, kind child—he didn’t deserve to die like that.”
She’s worked with prosecutors under three different state’s attorneys over the years trying to move forward with a trial.
“I was told by one prosecutor this was the oldest case in the courtroom to be told by another prosecutor I just need to accept it and begin to heal because no amount of time is going to bring my son back,” she said. “Heartless—how dare you.”
When NBC Chicago asked about the plea deal, the state’s attorney’s office said it couldn’t comment on pending cases.
She’s not happy with how the office has handled her son’s case.
“There has to be some type of change and it has to start now,” she said. “It can’t start later it can’t start with God forbid one of their children it has to start now.”
A second man was also charged in connection to her son’s murder. Wyndett was told Kevin Hines could go to trial before the end of the year.
As for Jackson, he’s in court next Tuesday.
