ROCHESTER, N.Y. — Mayor Malik Evans has extended the order that restricts groups of 10 or more people from gathering in public places at night without a permit.
The emergency order, which falls under the Gun Violence State of Emergency, must be extended every five days to remain in effect. Evans signed the first extension on Tuesday.
The mayor announced the restrictions last Thursday, saying they’re an effort to address “large gatherings that turn violent.” Under the order, it’s unlawful for groups of 10 or more people to gather in the streets between 11 p.m. and 5 a.m. unless they have permission from the city.
News10NBC has spoken to some members of the public and of city council who have criticized the new rule, and others who support it. To enforce the rule, police will first issue a warning. Rochester Police Chief David Smith says that, if the group refuses to disperse, officers will make arrests. According to the order, people who refuse to disperse could be arrested and issued a court appearance ticket for a class B misdemeanor.
There are some exceptions to the gathering restrictions. The city says it won’t shut down protests, other forms of protected First Amendment speech, or religious gatherings. Also, the city won’t stop workers from gathering for an employment purpose, stop people from gathering if they need to evacuate a building, or shut down properly permitted events.
