WASHINGTON — A federal judge has granted the Department of Justice’s request to dismiss the convictions of four Proud Boys members, including Rochester’s Dominic Pezzola, involved in the Jan. 6, 2021 riots at the U.S. Capitol.
The judge on Friday granted a motion to dismiss the convictions against Pezzola, Ethan Nordean, Joseph Biggs, and Zachary Rehl with prejudice, meaning the case is permanently closed, according to NBC News. Those four were among the 1,500 people involved in the riots who were pardoned or had their sentences commuted by President Donald Trump at the start of his second term.
The rioters breached the U.S. Capitol to stop the certification of the 2020 Presidential Election, in which Joe Biden defeated President Trump. Video shows Pezzola smashing a window at the U.S. Capitol with a police shield. At least three other people from the Rochester region were also found guilty or pleaded guilty in relation to the riots.
Timeline of Pezzola’s case
Pezzola was found guilty in 2023 of obstruction of an official proceeding, conspiracy to prevent Congress from discharging duties, and assaulting/impeding law enforcement. During the trial, Pezzola took the stand, admitting to smashing the window but claimed he wasn’t part of a plot to interfere with the presidency. During his sentencing, Pezzola shouted “Trump won” at reporters as he exited the courtroom.
In January of 2025, Trump commuted Pezzola’s 10-year prison sentence. Soon after, the North Carolina prison that held Pezzola confirmed to News10NBC that he had been released.
