On Tuesday, July 14, San Diego City Councilmembers are expected to give final approval of a $3.1 million settlement to a San Diego Police Sergeant who says he was racially discriminated against for over a decade. San Diego Police Sergeant Arthur Scott, a Black officer at the department for almost 30 years, filed three lawsuits over the span of 11 years, claiming racial discrimination and retaliation for reporting it to his superiors. Scott filed the last two legal complaints regarding an attempted termination, claiming he did not receive due process due to alleged discrimination and repeated confrontations with the department. The events leading up to Tuesday’s meeting date back to 2014, when Scott objected to discriminatory images and cartoons, such as exaggerated drawings of Black police officers and famous Black figures depicted in demeaning ways, in officer trainings and locker rooms. Months later, Scott was transferred to the Traffic Division and denied various promotions, despite his decades of service at the department, according to his lawsuit.Scott filed his first lawsuit against the city in 2015, claiming racial discrimination and retaliation. A jury ruled in favor of the city and against Scott in February 2017. Since that time, investigations have surfaced a range of incidents related to racial discrimination by members of the San Diego Police Department. In the years following, Scott testified twice against the department in sexual harassment and excessive force lawsuits. In response to his testimony, the department and the City Attorney’s Office then launched an internal investigation in 2023, alleging Scott lied under oath.Amid the investigation, Scott filed a second lawsuit. It alleged retaliation, race discrimination, and failure to prevent discrimination, and following that year, he was served a notice of termination. As his civil lawsuit moved through the court, Scott filed a petition to overturn his termination in 2025, adding the violation of his due process rights and termination limits.Tuesday, July 14, will determine the approval of the settlement after a prior closed vote on May 18 by City Councilmembers. When asked to comment on Scott’s settlement, his defense firm from the second suit, Gruenberg Law, declined. No response was received from Bobbitt, Pinckard & Fields, APC, the firm in the third suit. Times of San Diego reached out to San Diego Police Department to comment on the settlement and any steps they’re making to reduce discriminatory incidents in the future, but did not hear back.
