ROCHESTER, N.Y. — The Foundation for Individual Rights and Expression (FIRE) is filing a federal lawsuit after they say a Rochester man was confronted by federal agents for criticizing Immigration and Customs Enforcement.
What prompted the lawsuit
FIRE says David Streever wrote an email to the head of ICE during the agency’s January crackdown in Minnesota. In the email, Streever called the then-acting ICE Director Todd Lyons a “monstrous human being.”
Five months after that, FIRE says federal agents “went to extraordinary lengths to confront and intimidate” Streever.
What happened after the email
While Streever was in Finland with his 7-year-old daughter in late June, his front-door camera picked up two federal agents on his porch.
FIRE says the video shows the agents showing up to Streever’s house in the late afternoon, repeatedly ringing the doorbell. Soon after, Streever’s wife got home and saw the agents at the door.
The agents handed her a “warning notice” that explained Streever might be in violation of federal law for sending the email. The notice also said that he should “promptly … discontinue” his “behavior” and warns that the notice will be “taken into consideration” if he continues.
According to FIRE, federal agents staked out his New York City hotel after he returned from Finland.
The reason for the email
Streever told FIRE that he felt compelled to do something after the shooting in Minnesota in January, and he felt the email was the least he could do.
“Writing an email to the head of ICE seemed like the least I could do to express my sense of outrage. I never dreamed it would lead to a knock on my door by federal officers or descending on my hotel in the dark of night,” Streever said in a press release.
FIRE’S reasoning for the lawsuit
FIRE says Streever’s email only has “fully protected speech,” and nothing that justifies the agents’ actions.
“If someone is really threatening a government official, you don’t wait five months to act on it,” said FIRE Senior Attorney Adam Steinbaugh in a press release. “The fact that authorities didn’t respond immediately shows that David presented no threat. This pursuit is designed to intimidate lawful speech, pure and simple.”
