HOPEWELL, N.Y. — Guests at Patty’s Lodge in Hopewell received a letter Thursday giving them until 11 a.m. on Monday to leave the property.

David Kagle with Legal Assistance of Western New York said anyone who has been at the property more than 30 days is entitled to at least 30 days written notice before court action can start for an eviction. Guests at Patty’s Lodge only had 11 days, Kagle said.
The letter residents received says their personal property could be thrown out. Kagle said that would require an eviction notice if they have been there 30 days.
The letter also says utilities will be shut off. Kagle said that could be a Class A misdemeanor, which includes a civil penalty of up to $10,000 per violation, which could mean each tenant.
Guests at Patty’s Lodge said a new owner purchased the property a couple months ago. Kagle could not think of any instance where this 11-day eviction notice would be legal.
“I think it’s just important to recognize that the folks who are living at Patty’s Lodge, this is their home and this is where they live. While somebody may not be exactly where somebody wants to live and the fact that somebody has purchased a property doesn’t give them the right to ignore the protections of the folks who live in that property,” Kagle said.
News10NBC made several calls to management at Patty’s Lodge with a request for comment but has not heard back. Kagle said Legal Assistance of Western New York is taking action to challenge the conduct of the letter.
They have already notified utility companies like NYSEG and the Hopewell Water Board that the letter’s threats are unlawful. Kagle said it is not a bad idea for tenants to reach out to an attorney to see what actions they can take to protect themselves.
