Mackenzie Shirilla Taking Double Murder Conviction to Ohio Supreme Court

Mackenzie Shirilla is asking the Ohio Supreme Court to review her double murder conviction.

According to TMZ, her lawyers filed the appeal paperwork, alleging that "there is medical evidence" that Shirilla “suffered from a pre-existing medical condition that could have caused her to black out while driving.” They also said that her attorney didn't "properly investigate this possibility initially."

Court documents obtained by the outlet showed that the first appeal was rejected because it was filed a day late, which Shirilla's legal team claimed happened because they didn't properly account for the leap year.

"The state supreme court has not yet ruled on whether or not it will hear Mackenzie's case," TMZ writes.

Shirilla was convicted of double murder and was sentenced to two concurrent terms of 15 years to life with eligibility for parole in 2037 after she drove her car into a brick wall, going nearly 100 mph, killing her boyfriend, Dominic Russo, and their friend Davion Flanagan.

Her case has received increased attention recently due to the Netflix true crime documentary titled The Crash, which is a about the car crash.

In the Netflix documentary, Shirilla discusses what happened during the crash, saying that it was due to her 2017 diagnosis of POTS (postural orthostatic tachycardia syndrome), which caused her to "black out."

But during the bench trial, no medical records or expert testimony to confirm the diagnosis were given. Instead, the prosecutors showed that the gas pedal was floored and there was no attempt to use the brakes before the crash.

According to the Cleveland Clinic, POTS is a "is a condition that causes your heart to beat faster than normal when you transition from sitting or lying down to standing up," with the symptoms being "dizziness and fatigue."
